Thank you for choosing Furniture Castle. Our products and services are provided by Furniture Castle, operating through our online portal at www.furniturecastle.com.au ("Furniture Castle" or "furniturecastle.com.au"). References to "we," "our," and "us" pertain to Furniture Castle and its associated entities.
1. Use of the Site
By accessing and using our website, you agree to comply with these Terms & Conditions and our Privacy Policy. By registering, you consent to receive email communications. You may unsubscribe at any time via the link provided in our emails.
You agree not to use this site for any purpose that is unlawful, prohibited, or infringes upon the rights of Furniture Castle or others. Prohibited uses include but are not limited to:
- Transmitting unauthorized materials or data
- Attempting to gain unauthorized access to systems, APIs, or data.
- Impersonating any individual or misrepresenting identity
- Violating intellectual property or privacy rights
- Submitting false contact information
- Fraudulent or abusive activities
- Harvesting or collecting data for unsolicited communications
- Abusing referral, discount, or promotional programs (limit one per person, two per household)
By using this site or placing an order, you confirm your acceptance of these Terms & Conditions.
2. Intellectual Property
All content on this site—including text, images, logos, trademarks, audio, video, design, and software—is owned or licensed by Furniture Castle. You may not reproduce, modify, distribute, or use our content for commercial purposes without our prior written consent.
3. Products & Services
Product Descriptions: We aim to ensure product descriptions are accurate. However, we reserve the right to correct errors at any time. Colours may vary across screens.
Availability & Quality: Occasionally, items may be unavailable or not meet our standards. We may withdraw products or cancel orders at our discretion. In such cases, we will offer a full refund or store credit.
Product Imagery: Product photos may include accessories for display purposes only. Items with intricate or hand-painted details are unique and may vary slightly from the displayed images.
4. Order Acceptance & Processing
Your order is confirmed only when we dispatch the item and notify you via email. We reserve the right to:
- Cancel orders if payment is not authorized or fraud is suspected.
- Refuse service to any customer not meeting eligibility requirements.
Custom Orders:
- Require a 50% deposit to commence production.
- Typically have a lead time of 60–120 days, subject to change
- Cannot be cancelled once in production.
- Are non-returnable unless faulty or misdescribed.
5. Pricing, Payment & Charges
- All prices are in AUD and include GST.
- We accept Visa, MasterCard, Amex, and PayPal
- Prices may change without notice.
- Payment must be made in full before delivery.
- Cancellations after order placement incur a 20% restocking fee.
- Late payments are subject to 10% interest.
- Freight is charged separately unless stated otherwise.
- Storage fees apply if items are not collected within 2 weeks of arrival.
6. Payment Security
We use industry-standard encryption. We do not store payment details permanently. For high-value or suspicious orders, we may carry out additional verification before processing.
7. Delivery
Standard Delivery: One-person kerbside delivery to ground floor/front door during weekdays only. No upstairs or lift service.
Two-Man Delivery: Includes placement inside the room of choice, where accessible and safe.
- We deliver to most Australian locations. Delivery to PO Boxes is not available.
- If unavailable to accept delivery, a redelivery fee will apply.
- Customers must ensure adequate access to their premises.
- High-risk or inaccessible locations may require alternate arrangements by the customer.
Risk in the goods passes to the customer upon delivery.
8. Product Understanding & Care
- Weights and dimensions are approximate.
- Colour variation across devices is not a fault.
- Furniture exposed to moisture, sunlight, or chemicals may deteriorate.
- Minor chips, blemishes, or natural material variances (veins, patterns) are not defects.
9. Fabrics
- Fabric batches may vary in colour or texture.
- Sunlight and certain chemicals may cause discolouration. Use caution with aerosols and neutralizers.
- We recommend dry-cleaning upholstery covers.
- We are not responsible for mould/mildew caused by environmental exposure.
10. Warranty
Coverage:
- 12-month structural warranty on all furniture (excluding marble/natural stone)
- 2-year base warranty on custom furniture (conditions apply)
Exclusions:
- Wear and tear, misuse, improper care, direct sunlight, moisture damage
- Damage to packaging, superficial blemishes, modified goods
- Natural variations in colour, grain, or finish
To Claim: Email info@furniturecastle.com.au with:
- Order/invoice number
- Description of issue
- Photos of damage/fault
- Proof of purchase
11. Returns & Refunds
- Returns are only accepted for incorrect or faulty items, not for change-of-mind unless pre-approved.
- Items must be in original condition and packaging.
- Shipping promotions are reversed upon return (actual costs deducted from refund)
- Custom-made or pre-ordered items are not eligible for return unless faulty.
- Customers are responsible for returning items safely and insuring them during transit.
12. Damages
- Report damage immediately at delivery or within 72 hours by email
- Furniture Castle will assess and determine corrective measures (replacement, repair, etc.)
- Missing assembly parts must be reported promptly.
13. Out-of-Stock Items
If an item is out of stock before dispatch, we will notify you and offer a refund or store credit. Orders may also be cancelled if payment fails, or fraud is suspected.
14. Your Rights Under Australian Consumer Law
Nothing in these Terms excludes your rights under the Australian Consumer Law. You are entitled to:
- Refund or replacement for major failures
- Repair or replacement for minor defects
- Compensation for reasonably foreseeable loss
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of Victorian courts.
